What Debts can be included in an IVA

There are some debts which can be included in an IVA and some which cannot be included.  Please see the list below.

Debts which can be included in an IVA

Any unsecured borrowing including:

  •   Unsecured loan
  •   Overdraft
  •   Credit Card
  •   Store Card
  •   Credit Union Loan
  •   Solicitor Fees – if no longer acting on you behalf
  •   Vets/ Doctors/ Dentist/ School Fees – if no longer using the service
  •   Hire purchase shortfall for car – if you no longer have the vehicle because it has been    repossessed or voluntarily surrendered back to the finance company
  •   Department of works and pensions – overpaid council rent/ benefits/ social loan
  •   Previous private landlord rent
  •   Utilitity bills from previous addresses – only if you have a new supplier
  •   Disconnected mobile phone bills

If any of the above is subject to a CCJ we can still deal with it

Debts which cannot be included in an IVA

  •   Mortgages
  •   Secured Loans
  •   Current Hire Purchase Agreements
  •   Magistrate court fines
  •   Parking fines
  •   Driving related fines
  •   Recent council tax
  •   Current rent arrears
  •   Current utility bills
  •   Debts in anyone else’s name other than client
  •   Loans with guarantor
  •   New loans – which have never had a contractual payment made
  •   Current mobile phone bill
  •   Accounts with Brighthouse, Crazy George’s Log Book Loans
  •   Gambling debt less than 3 months old
